GDPR + SOC 2 + HIPAA: One Evidence Library, Three Compliance Frameworks
How to build a single evidence library that satisfies SOC 2, GDPR, and HIPAA audit requirements simultaneously — which controls overlap and what's unique to each.
The Triple Framework Challenge
More SaaS companies than ever need to satisfy all three: SOC 2 for US enterprise buyers, HIPAA for healthcare customers, and GDPR for EU customers. Running three separate compliance programs means:
- Three separate evidence libraries (or three views of the same messy shared folder)
- Three separate audit preps, each consuming engineering time
- Three separate tools or modules
- Three separate sets of recurring processes
The Overlap Map
Technical controls that satisfy all three:
| Control | SOC 2 | HIPAA | GDPR |
| Encryption at rest (AES-256) | CC5 | §164.312(a)(2)(iv) | Art. 32 |
| Encryption in transit (TLS 1.2+) | CC5 | §164.312(e)(2)(ii) | Art. 32 |
| Access control + least privilege | CC6 | §164.312(a)(1) | Art. 25 |
| User access reviews | CC6 | §164.308(a)(3) | Art. 5(1)(f) |
| Audit logging | CC4, CC7 | §164.312(b) | Art. 30 |
| Incident response | CC7 | §164.308(a)(6) | Art. 33 |
| Vendor management | CC9 | §164.308(b) | Art. 28 |
| MFA enforcement | CC6 | §164.312(d) | Art. 25 |
What's Unique to Each Framework
HIPAA-only requirements:
- PHI-specific workforce training: General security training isn't enough. You need documented training specifically about PHI handling, safeguarding, and breach procedures — and records showing every employee completed it.
- Physical safeguards: Workstation security policies, device/media controls, and facility access controls. If you're cloud-only with remote employees, this is mostly policy documentation.
- BAAs with all PHI-processing vendors: Every vendor who touches PHI must sign a Business Associate Agreement. This is a contract requirement, not a technical control.
- Contingency planning with RPO/RTO: Your business continuity plan must specifically address systems containing PHI and define recovery objectives.
- Data subject rights processes: GDPR Articles 15–22 give EU data subjects the right to access, correct, delete, and export their personal data. You need documented processes for handling these requests within 30 days.
- Data Protection Impact Assessments (DPIAs): Required for high-risk processing (large-scale processing of special categories, systematic monitoring). Documents the risk assessment and mitigations for each processing activity.
- Legal basis documentation: For each category of personal data you process, you must document the legal basis (consent, contract, legitimate interests, legal obligation, vital interests, or public task).
- Supervisory authority breach notification (72 hours): A data breach affecting EU personal data must be reported to the relevant data protection authority within 72 hours of becoming aware.
- Trust Services Criteria structure: The CC1–CC9 framing is specific to SOC 2. Your evidence needs to be mapped to these criteria, not just described as good security practice.
- Auditor workspace: The CPA firm conducting your SOC 2 audit needs access to your evidence in a structured, navigable form. HIPAA and GDPR audits are different in format.
- Type I / Type II distinction: Unique to SOC 2. HIPAA and ISO 27001 don't have an equivalent.
Building the Unified Program
Step 1: Activate all three frameworks in SecureSpect. The system maps your existing controls to all three simultaneously. You see immediately which controls are shared and which gaps are framework-specific.
Step 2: Address framework-specific gaps. For HIPAA: add PHI training records, ensure all PHI vendors have BAAs. For GDPR: document legal bases, set up data subject request process, add breach notification procedure to IR plan.
Step 3: Configure evidence collection to tag by framework. Each piece of evidence is linked to its relevant controls across all active frameworks. Your CloudTrail configuration doesn't just satisfy SOC 2 CC4 — it's automatically tagged as evidence for HIPAA §164.312(b) and GDPR Art. 30 as well.
Step 4: Set up framework-specific processes. Quarterly access reviews satisfy all three. PHI training needs to be tracked separately. Data subject access request handling needs a dedicated workflow.
The Audit Efficiency Gain in Practice
A company running SOC 2, HIPAA, and GDPR separately might spend 300+ engineering hours per year on combined audit prep. Running them from a unified program in SecureSpect typically reduces that to 60–80 hours, because:
- Evidence is collected once and reused across frameworks
- Recurring processes (access reviews, vendor assessments) satisfy multiple frameworks simultaneously
- The auditor workspace can be configured to show framework-specific views of the same evidence
- Control testing and evidence health monitoring are done once for all frameworks
The 75% reduction in audit prep time compounds: over 3 years, that's 600+ hours of engineering time saved — at fully-loaded costs, over $120,000.
